i had a relative of mine who is a corporate attorney look over deviantART's submission agreement. She said that although there are sections in it that should raise concern with anyone who might sign it, she didn't find anything illegal about it. Unethical and immoral- yes- and she's going to send me a list of those along with the case law which applies to each section she outlines. she feels that because of some of the ethical issues the agreement could be challenged in a court of law if someone wished to do that. however, she said that barring a court decision- deviantART Inc. owns each and every one of us that signed that agreement body and soul. Why is that?
because of a Survival Clause in the agreement which reads:

Survival. The provisions of Sections 1, 3(e), 4(b) 5, 6, 7, 8, 10, 11, 12, 13, and 14 shall survive any termination of this Agreement.

in other words, even if you delete all your work, terminate your agreement with deviantART Inc and never return here deviantART Inc can keep copies of your work on their servers and they have the right to continue to sell prints or calendars etc. using your work in whatever manner they see fit. for eternity. and there's nothing you can do about it. and because of what is stated in previous sections of the agreement they can also transfer rights to all of your work to any other website or company. for eternity. how disturbing is that?

deviantART Inc really does pwn us don't they?






an explanation has been given as to why splat was demoted. we are being told that jark did not go through proper procedure when he made splat senior. so it was removed and it is being reviewed. i await jark 's take on that explanation.
